There’s been a lot of speculation recently about a “ruling” on the Hudson Tunnel Project. Here’s what actually happened, and what to watch next.
As of the morning of February 12th, there has been no formal ruling from the Court of Federal Claims.
The recent session was a status conference, not a final hearing on the breach-of-contract case. The focus was on setting the ground rules for the next several weeks.
Here’s what comes next:
- Oral arguments for the GDC’s motion are set for March 12, 2026.
- A separate, more immediate deadline looms in the other lawsuit filed by the states. An appellate judge has given the federal government until Today, February 12, to actually resume the flow of Gateway funding following its appeal. There is a 5 PM deadline.
While a final decision on the $205 million reimbursement or the full $15 billion Gateway funding package may still be weeks away, Thursday is pivotal. By then, we should know whether payments are truly restarting, or whether the funding crisis continues.
Thousands of workers, half a million daily commuters, and the region’s economy are still waiting for certainty. This project cannot operate on pauses, appeals, and ambiguity.
